By accessing or using Cloudpals, you agree to be bound by these Terms of Use and all applicable laws and regulations.
Cloudpals is operated by Software Futurism. References to "Cloudpals", "we", "us", or "our" mean Software Futurism and the Cloudpals service.
Cloudpals is available to users aged 13 and older. We classify users into teen accounts (ages 13-17) and adult accounts (ages 18+). You must provide accurate age information and keep it current.
Accounts suspected to be under 13, or to have inaccurate age information, may be restricted, suspended, or permanently terminated pending verification.
To help protect users, Cloudpals enforces age-aware interaction rules. For clarity, "eligible users" means active users with access to discovery surfaces under applicable account status, block, and visibility controls. On Search, feed previews, and profile surfaces, teen and adult accounts may both be visible to eligible users.
Cross-age visibility does not mean unrestricted contact. New teen/adult private one-to-one pathways are blocked, including new message requests, accepting requests that would open a new private channel, sending new direct messages, gifting, and matchmaking initiation (including swipe and super-swipe flows). Existing historical cross-age conversations from before enforcement may remain viewable, but new cross-age private sends are blocked.
Cloudpals uses a risk-based age-assurance workflow. Depending on risk signals, we may require age recheck, temporarily restrict account actions, or block accounts identified as under 13.
For teen-owned feed content, adult-to-teen commenting is rate-limited to at most 2 comments per adult user per teen-owned post item and at most 2 comments per adult user per teen-owned media item.
You agree to use Cloudpals only for lawful purposes related to language learning. You are prohibited from posting offensive, discriminatory, or harmful content, and from harassing other users.
Child sexual abuse and exploitation (CSAE) content and behavior are strictly prohibited. This includes CSAM, grooming, sexual solicitation of minors, trafficking, and any attempt to exploit minors on or off platform. You must report suspected violations immediately. Our full child-safety rules are set out in the CSAE Policy, which forms part of these Terms.
Cloudpals Gold is a premium subscription service. Payments will be charged to your app store account at confirmation of purchase. Subscriptions automatically renew unless cancelled.
Before subscribing or buying digital items, you are responsible for reviewing the price, billing period, renewal terms, included features, and any usage limits shown in the app store purchase flow or in Cloudpals. Cancelling a subscription stops future renewals but does not automatically refund charges that have already been billed.
Purchases made through Apple App Store or Google Play are billed by the applicable app store and are subject to that store's refund rules, payment rules, and applicable law.
Coins, gifts, boosts, premium features, and similar digital items are generally non-refundable once delivered, used, consumed, transferred, or applied, except where required by applicable law or app store policy.
If a purchase is refunded, reversed, charged back, or voided, Cloudpals may remove the related entitlement, deduct credited coins, reverse unused digital items, restrict further purchases, or take other reasonable anti-abuse measures. Repeated refund, chargeback, or purchase-abuse activity may result in account restrictions.
Nothing in these Terms limits any non-excludable consumer rights, including rights relating to faulty, unavailable, or misdescribed digital content.
You retain ownership of the content you post on Cloudpals. However, by posting content, you grant us a non-exclusive, royalty-free license to use, modify, and display that content.
Cloudpals may investigate, remove, restrict, or disable content or accounts that violate these Terms or applicable law. Where required by law (including EU DSA obligations where applicable), Cloudpals provides notice of moderation decisions and a process for eligible appeals or complaints.
Where child-safety risk is detected, Cloudpals may apply temporary restrictions before final review in order to prevent potential harm.
Cloudpals is provided for social language learning and related community features. We do not guarantee that language suggestions, translations, corrections, matches, recommendations, AI-generated content, or user content will be complete, accurate, available, safe, or suitable for your particular purpose.
Cloudpals may include automated or AI-assisted features. These features can make mistakes. You are responsible for checking important information before relying on it.
We may change, suspend, limit, or discontinue features where needed for security, safety, legal compliance, product improvement, maintenance, or operational reasons.
To the maximum extent permitted by law, Cloudpals is provided on an "as is" and "as available" basis. We do not make warranties that the service will be uninterrupted, error-free, secure, free from harmful content, or meet your expectations.
We are not responsible for content, conduct, messages, profiles, or activity provided by other users. You are responsible for your own interactions and for using the service safely and lawfully.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law.
To the maximum extent permitted by law, Software Futurism and Cloudpals will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or opportunities arising from your use of, or inability to use, Cloudpals.
To the maximum extent permitted by law, our total liability for claims relating to Cloudpals will be limited to the amount you paid to Cloudpals through the app stores in the 12 months before the event giving rise to the claim, or GBP 50 if you paid nothing during that period.
You are responsible for your content, account activity, purchases, and interactions on Cloudpals. You agree not to misuse the service, attempt to obtain benefits without payment, abuse refund or chargeback processes, evade restrictions, or assist others in doing so.
To the extent permitted by law, you agree to compensate Software Futurism for losses, liabilities, claims, damages, costs, and expenses arising from your unlawful use of Cloudpals, your content, your breach of these Terms, or your violation of another person's rights.
We reserve the right to terminate or suspend your account and access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms.
Account suspension, restriction, or termination for breach of these Terms, safety risk, fraud, underage use, chargeback abuse, or legal compliance does not automatically entitle you to a refund, except where required by applicable law or app store policy.
Cloudpals may preserve and disclose information where required by law, lawful request, or to protect users, children, or the public. This includes cooperation with regulators, law enforcement, and child-protection authorities in the UK, U.S., EU, and other jurisdictions.
These Terms are governed by the laws of England and Wales, except where mandatory consumer-protection laws in your country or region require otherwise.
